The law regarding the protection of plant varieties is a very specific industrial property right. It offers protection for new plant varieties and their designations, provided that the varieties have not yet been included in the list of varieties.
The statutory basis for the protection of plant varieties is provided in Germany by the Plant Variety Protection Act [Sortenschutzgesetz]. In addition, just one registration at the Community office of plant varieties can provide protection throughout the EU.
